RELEASE AND WAIVER OF LIABILITY

By executing this Release and Waiver of Liability (the “Agreement”), I, the undersigned (on my own behalf and on behalf of my organization, (the “client”) acknowledge that HR Anytime LLC (the “Company”) is a licensed Human Resources Organization that provides services to client, including advice and recommendations based on information provided by client.

Client hereby acknowledges that Company and its employees are not providing legal advice and, further, Client releases, discharges, holds harmless and agrees to indemnify Company and its employees and agents (“Released Parties”) from any and all liability, claims, demands, damages, rights or causes of action of any kind whatsoever, including all fees (including attorney fees) costs or expenses related thereto, in any way resulting from, arising out of, or in connection with action or inaction based on the advice, recommendation or other services provided by Company.

This Agreement extends to any and all claims I have or later may have against the Released Parties whether or not such claims result from negligence (except gross negligence or willful or wanton conduct) on the part of any or all of the RELEASED PARTIES with respect to the services provided or from any other cause.

I UNDERSTAND THAT THIS MEANS THAT, EXCEPT AS TO ANY GROSS NEGLIGENCE OR WILLFUL OR WANTON CONDUCT OF THE RELEASED PARTIES, I AGREE NOT TO SUE ANY OR ALL OF THE RELEASED PARTIES FOR ANY INJURY RESULTING TO MYSELF OR MY PROPERTY ARISING FROM, OR IN CONNECTION WITH THE COMPANY’S ACTIONS.

If any portion of this Agreement should by deemed to be invalid or contrary to law, I understand that the remaining portion or portions of the Agreement shall be deemed to be valid and given full legal effect.

By signing this Agreement, I certify that I have read this Agreement and am fully familiar with and understand its contents; that I am not relying on any other statements, representations, inducements or assurances of any nature by the RELEASED PARTIES; and that I am giving up substantial legal rights by signing below.
